Michael Bennett is facing charges of Criminal Mischief and Criminal Trespass in connection with the damage at the remote graveyard on the South Oakfield Road.  The Sheriff’s Office said Wednesday that the charges are misdemeanors but could be upgraded if the damage estimates are above a specific figure.

The suspect was identified and charged after police asked for tips from the public. Police did not say if the alleged vandalism involved damage to specific grave markers.

The Sheriff’s Office said Bennett is already on two terms of probation. One is for a 2013 conviction for assault on an officer and the second is for a 2016 conviction for burglary.
